Article 54 GDPR. Rules on the establishment of the supervisory authority

1. Kull Stat Membru għandu jipprevedi bil-liġi għal dawn kollha li ġejjin:

1. Each Member State shall provide by law for all of the following:

(a) l-istabbiliment ta’ kull awtorità superviżorja;

(a) the establishment of each supervisory authority;

(b) il-kwalifiki u l-kondizzjonijiet ta’ eliġibbiltà meħtieġa biex wieħed jinħatar membru ta’ kull awtorità superviżorja;

(b) the qualifications and eligibility conditions required to be appointed as member of each supervisory authority;

(c) ir-regoli u l-proċeduri għall-ħatra tal-membru jew membri ta’ kull awtorità superviżorja;

(c) the rules and procedures for the appointment of the member or members of each supervisory authority;

(d) it-tul tal-mandat tal-membru jew il-membri ta’ kull awtorità superviżorja ta’ mhux inqas minn erba’ snin, ħlief għall-ewwel ħatra wara l-24 ta’ Mejju 2016, li parti minnu jista’ jseħħ għal perijodu iqsar fejn dak jinħtieġ għall-protezzjoni tal-indipendenza tal-awtorità superviżorja permezz ta’ proċedura ta’ ħatra mqassma;

(d) the duration of the term of the member or members of each supervisory authority of no less than four years, except for the first appointment after 24 May 2016, part of which may take place for a shorter period where that is necessary to protect the independence of the supervisory authority by means of a staggered appointment procedure;

(e) jekk u, jekk ikun il-każ, għal kemm-il mandat il-membru jew il-membri ta’ kull awtorità superviżorja hu eliġibbli għall-ħatra mill-ġdid;

(e) whether and, if so, for how many terms the member or members of each supervisory authority is eligible for reappointment;

(f) il-kondizzjonijiet li jirregolaw l-obbligi tal-membru jew il-membri u l-persunal ta’ kull awtorità superviżorja, il-projbizzjonijiet ta’ azzjonijiet, okkupazzjonijiet u benefiċċji inkompatibbli ma’ dawn matul u wara l-mandat u r-regoli li jirregolaw it-tmiem tal-impjieg.

(f) the conditions governing the obligations of the member or members and staff of each supervisory authority, prohibitions on actions, occupations and benefits incompatible therewith during and after the term of office and rules governing the cessation of employment.

2. Il-membru jew il-membri u l-persunal ta’ kull awtorità superviżorja għandhom, f’konformità mal-liġi tal-Unjoni jew ta’ Stat Membru, ikunu soġġetti għal dmir ta’ segretezza professjonali kemm matul kif ukoll wara l-mandat tagħhom, fir-rigward ta’ kwalunkwe informazzjoni kunfidenzjali li jkunu saru jafu biha matul it-twettiq tal-kompiti tagħhom jew l-eżerċizzju tas-setgħat tagħhom. Matul il-mandat tagħhom, dak id-dmir ta’ segretezza professjonali għandu japplika b’mod partikolari għar-rappurtar minn persuni fiżiċi ta’ ksur ta’ dan ir-Regolament.

2. The member or members and the staff of each supervisory authority shall, in accordance with Union or Member State law, be subject to a duty of professional secrecy both during and after their term of office, with regard to any confidential information which has come to their knowledge in the course of the performance of their tasks or exercise of their powers. During their term of office, that duty of professional secrecy shall in particular apply to reporting by natural persons of infringements of this Regulation.

(121) Il-kondizzjonijiet ġenerali għall-membru jew il-membri tal-awtorità superviżorja għandhom jiġu stabbiliti bil-liġi f'kull Stat Membru u għandhom b'mod partikolari jipprovdu sabiex dawk il-membri jinħatru, permezz ta' proċedura trasparenti, jew mill-parlament, jew mill-gvern jew mill-Kap tal-Istat tal-Istat Membru abbażi ta' proposta mill-gvern, jew minn membru tal-gvern, jew mill-parlament jew minn kamra tal-parlament, jew minn korp indipendenti inkarigat taħt il-liġi ta' Stat Membru. Sabiex tiġi żgurata l-indipendenza tal-awtorità superviżorja, il-membru jew il-membri għandhom jaġixxu b'integrità, jibqgħu lura minn kwalunkwe azzjoni li ma tkunx kompatibbli ma' dmirijiethom u matul il-mandat tagħhom, ma għandhom jinvolvu ruħhom fl-ebda xogħol li ma jkunx kompatibbli, sew jekk bi qligħ sew jekk le. L-awtorità superviżorja għandu jkollha l-persunal tagħha stess, magħżul mill-awtorità superviżorja jew korp indipendenti stabbilit bil-liġi ta' Stat Membru, li għandu jkun suġġett għat-tmexxija esklużiva tal-membru jew tal-membri tal-awtorità superviżorja.

(121) The general conditions for the member or members of the supervisory authority should be laid down by law in each Member State and should in particular provide that those members are to be appointed, by means of a transparent procedure, either by the parliament, government or the head of State of the Member State on the basis of a proposal from the government, a member of the government, the parliament or a chamber of the parliament, or by an independent body entrusted under Member State law. In order to ensure the independence of the supervisory authority, the member or members should act with integrity, refrain from any action that is incompatible with their duties and should not, during their term of office, engage in any incompatible occupation, whether gainful or not. The supervisory authority should have its own staff, chosen by the supervisory authority or an independent body established by Member State law, which should be subject to the exclusive direction of the member or members of the supervisory authority.
