Article 55 GDPR. Competence

1. Kull awtorità superviżorja għandha tkun kompetenti biex twettaq il-kompiti assenjati lilha u l-eżerċizzju tas-setgħat ikkonferiti lilha f’konformità ma’ dan ir-Regolament fit-territorju tal-Istat Membru tagħha stess.

1. Each supervisory authority shall be competent for the performance of the tasks assigned to and the exercise of the powers conferred on it in accordance with this Regulation on the territory of its own Member State.

2. Fejn l-ipproċessar titwettaq minn awtoritajiet pubbliċi jew korpi privati li jaġixxu abbażi tal-punt (c) jew (e) tal-Artikolu 6(1), għandha tkun kompetenti l-awtorità superviżorja tal-Istat Membru kkonċernat. F’tali każijiet ma japplikax l-Artikolu 56.

2. Where processing is carried out by public authorities or private bodies acting on the basis of point (c) or (e) of Article 6(1), the supervisory authority of the Member State concerned shall be competent. In such cases Article 56 does not apply.

(122) Kull awtorità superviżorja għandu jkollha kompetenza fit-territorju tal-Istat Membru tagħha stess biex teżerċita s-setgħat u twettaq il-kompiti li tingħata f'konformità ma' dan ir-Regolament. Dan għandu jkopri b'mod partikolari l-ipproċessar fil-kuntest tal-attivitajiet ta' stabbiliment tal-kontrollur jew il-proċessur fit-territorju tal-Istat Membru tiegħu stess, l-ipproċessar ta' data personali li jitwettaq minn awtoritajiet pubbliċi jew korpi privati li jaġixxu fl-interess pubbliku, l-ipproċessar li jolqot is-suġġetti tad-data fit-territorju tiegħu jew l-ipproċessar li jsir minn kontrollur jew proċessur mhux stabbilit fl-Unjoni meta dan ikun qed jimmira lejn suġġetti tad-data li jgħixu fit-territorju tiegħu. Dan għandu jinkludi t-trattament ta' ilmenti mressqa minn suġġett tad-data, it-twettiq ta' investigazzjonijiet dwar l-applikazzjoni ta' dan ir-Regolament u l-promozzjoni tal-għarfien tal-pubbliku dwar ir-riskji, ir-regoli, is-salvagwardji u d-drittijiet b'rabta mal-ipproċessar ta' data personali.

(122) Each supervisory authority should be competent on the territory of its own Member State to exercise the powers and to perform the tasks conferred on it in accordance with this Regulation. This should cover in particular the processing in the context of the activities of an establishment of the controller or processor on the territory of its own Member State, the processing of personal data carried out by public authorities or private bodies acting in the public interest, processing affecting data subjects on its territory or processing carried out by a controller or processor not established in the Union when targeting data subjects residing on its territory. This should include handling complaints lodged by a data subject, conducting investigations on the application of this Regulation and promoting public awareness of the risks, rules, safeguards and rights in relation to the processing of personal data.
