Article 90 GDPR. Obligations of secrecy

1. L-Istati Membri jistgħu jadottaw regoli speċifiċi biex jistabbilixxu s-setgħat tal-awtoritajiet superviżorji stipulati fil-punti (e) u (f) tal-Artikolu 58(1) b’rabta ma’ kontrolluri jew proċessuri li jkunu soġġetti, taħt il-liġi tal-Unjoni jew ta’ Stat Membru jew ir-regoli stabbiliti minn korpi kompetenti nazzjonali, għal obbligu ta’ segretezza professjonali jew obbligi ekwivalenti oħra ta’ segretezza fejn dan ikun meħtieġ u proporzjonat biex jiġi rrikonċiljat id-dritt tal-protezzjoni ta’ data personali mal-obbligu ta’ segretezza. Dawk ir-regoli għandhom japplikaw biss fir-rigward ta’ data personali li l-kontrollur jew il-proċessur ikun irċieva b’riżultat ta’ jew kiseb f’attività koperta minn dak l-obbligu ta’ segretezza.

1. Member States may adopt specific rules to set out the powers of the supervisory authorities laid down in points (e) and (f) of Article 58(1) in relation to controllers or processors that are subject, under Union or Member State law or rules established by national competent bodies, to an obligation of professional secrecy or other equivalent obligations of secrecy where this is necessary and proportionate to reconcile the right of the protection of personal data with the obligation of secrecy. Those rules shall apply only with regard to personal data which the controller or processor has received as a result of or has obtained in an activity covered by that obligation of secrecy.

(164) Fir-rigward tas-setgħat tal-awtoritajiet superviżorji biex jiksbu l-aċċess mill-kontrollur jew mill-proċessur għad-data personali u aċċess għall-bini tagħhom, l-Istati Membri jistgħu jadottaw permezz ta' liġi, fil-limiti ta' dan ir-Regolament, regoli speċifiċi sabiex jissalvagwardjaw l-obbligi professjonali jew obbligi ta' segretezza oħrajn ekwivalenti, dment li dan ikun meħtieġ sabiex id-dritt għall-protezzjoni tad-data personali jkun irrikonċiljat mal-obbligu ta' segretezza professjonali. Dan huwa mingħajr preġudizzju għall-obbligi eżistenti tal-Istati Membri li jadottaw regoli dwar is-segretezza professjonali fejn ikun meħtieġ mil-liġi tal-Unjoni.

(164) As regards the powers of the supervisory authorities to obtain from the controller or processor access to personal data and access to their premises, Member States may adopt by law, within the limits of this Regulation, specific rules in order to safeguard the professional or other equivalent secrecy obligations, in so far as necessary to reconcile the right to the protection of personal data with an obligation of professional secrecy. This is without prejudice to existing Member State obligations to adopt rules on professional secrecy where required by Union law.
