Article 77 GDPR. Right to lodge a complaint with a supervisory authority

1. Mingħajr preġudizzju għal kwalunkwe rimedju amministrattiv jew ġudizzjarju ieħor, kull suġġett tad-data għandu d-dritt li jressaq ilment quddiem awtorità superviżorja, b’mod partikolari fl-Istat Membru tar-residenza abitwali tiegħu, il-post tax-xogħol tiegħu jew il-post tal-ksur allegat, jekk is-suġġett tad-data jqis li l-ipproċessar ta’ data personali dwaru jikser dan ir-Regolament.

1. Without prejudice to any other administrative or judicial remedy, every data subject shall have the right to lodge a complaint with a supervisory authority, in particular in the Member State of his or her habitual residence, place of work or place of the alleged infringement if the data subject considers that the processing of personal data relating to him or her infringes this Regulation.

2. L-awtorità superviżorja li magħha jkun sar l-ilment għandha tinforma lill-ilmentatur dwar il-progress u l-eżitu tal-ilment inkluża l-possibbiltà ta’ rimedju ġudizzjarju skont l-Artikolu 78.

2. The supervisory authority with which the complaint has been lodged shall inform the complainant on the progress and the outcome of the complaint including the possibility of a judicial remedy pursuant to Article 78.

Article 78 GDPR. Right to an effective judicial remedy against a supervisory authority

1. Mingħajr preġudizzju għal kwalunkwe rimedju amministrattiv jew mhux ġudizzjarju ieħor, kull persuna fiżika jew ġuridika għandu jkollha d-dritt għal rimedju ġudizzjarju effettiv kontra deċiżjoni legalment vinkolanti ta’ awtorità superviżorja li tikkonċernaha.

1. Without prejudice to any other administrative or non-judicial remedy, each natural or legal person shall have the right to an effective judicial remedy against a legally binding decision of a supervisory authority concerning them.

2. Mingħajr preġudizzju għal kwalunkwe rimedju amministrattiv jew mhux ġudizzjarju ieħor, kull suġġett tad-data għandu d-dritt għal rimedju ġudizzjarju effettiv fejn l-awtorità superviżorja li hija kompetenti skont l-Artikoli 55 u 56 ma titrattax ilment jew ma tinformax lis-suġġett tad-data fi żmien tliet xhur dwar il-progress jew l-eżitu tal-ilment skont l-Artikolu 77.

2. Without prejudice to any other administrative or non-judicial remedy, each data subject shall have the right to a an effective judicial remedy where the supervisory authority which is competent pursuant to Articles 55 and 56 does not handle a complaint or does not inform the data subject within three months on the progress or outcome of the complaint lodged pursuant to Article 77.

3. Il-proċedimenti kontra awtorità superviżorja għandhom jitressqu quddiem il-qrati tal-Istat Membru fejn tkun stabbilita l-awtorità superviżorja.

3. Proceedings against a supervisory authority shall be brought before the courts of the Member State where the supervisory authority is established.

4. Fejn jitressqu proċedimenti kontra deċiżjoni ta’ awtorità superviżorja li kienet preċeduta minn opinjoni jew deċiżjoni tal-Bord fil-mekkaniżmu ta’ konsistenza, l-awtorità superviżorja għandha tibgħat dik l-opinjoni jew id-deċiżjoni lill-qorti.

4. Where proceedings are brought against a decision of a supervisory authority which was preceded by an opinion or a decision of the Board in the consistency mechanism, the supervisory authority shall forward that opinion or decision to the court.

(141) Kull suġġett tad-data għandu jkollu d-dritt li jressaq ilment quddiem awtorità superviżorja unika, b'mod partikolari fl-Istat Membru tar-residenza abitwali tiegħu, u jkollu d-dritt għal rimedju ġudizzjarju effettiv f'konformità mal-Artikolu 47 tal-Karta jekk is-suġġett tad-data jqis li jkun hemm ksur tad-drittijiet tiegħu skont dan ir-Regolament jew fejn l-awtorità superviżorja ma tiħux azzjoni b'rabta ma' ilment, tirrifjuta jew tiċħad l-ilment parzjalment jew kompletament jew ma tiħux azzjoni fejn tali azzjoni tkun meħtieġa għall-protezzjoni tad-drittijiet tas-suġġett tad-data. L-investigazzjoni li ssegwi l-ilment għandha titwettaq, soġġett għal stħarriġ ġudizzjarju, dment li tkun adatta fil-każ speċifiku. L-awtorità superviżorja għandha tinforma lis-suġġett tad-data dwar il-progress u l-eżitu tal-ilment f'perijodu ta' żmien raġonevoli. Jekk il-każ ikun jeħtieġ aktar investigazzjoni jew koordinazzjoni ma' awtorità superviżorja oħra, is-suġġett tad-data għandu jingħata informazzjoni intermedjarja. Bil-għan li tiffaċilita s-sottomissjoni ta' ilmenti, kull awtorità superviżorja għandha tieħu miżuri bħall-forniment ta' formola għas-sottomissjoni tal-ilmenti li tista' timtela wkoll b'mod elettroniku, mingħajr ma jiġu esklużi mezzi oħrajn ta' komunikazzjoni.

(141) Every data subject should have the right to lodge a complaint with a single supervisory authority, in particular in the Member State of his or her habitual residence, and the right to an effective judicial remedy in accordance with Article 47 of the Charter if the data subject considers that his or her rights under this Regulation are infringed or where the supervisory authority does not act on a complaint, partially or wholly rejects or dismisses a complaint or does not act where such action is necessary to protect the rights of the data subject. The investigation following a complaint should be carried out, subject to judicial review, to the extent that is appropriate in the specific case. The supervisory authority should inform the data subject of the progress and the outcome of the complaint within a reasonable period. If the case requires further investigation or coordination with another supervisory authority, intermediate information should be given to the data subject. In order to facilitate the submission of complaints, each supervisory authority should take measures such as providing a complaint submission form which can also be completed electronically, without excluding other means of communication.
