(152) 當本規則未就行政罰鍰定有一致規範，或在其他案件中有必要 者，例如嚴重違反本規則之情況時，會員國應採用有效、適當及懲戒 性處罰之制度。此等處罰屬刑事或行政性質，應由會員國法律決定 之。
(152) Where this Regulation does not harmonise administrative penalties or where necessary in other cases, for example in cases of serious infringements of this Regulation, Member States should implement a system which provides for effective, proportionate and dissuasive penalties.
The nature of such penalties, criminal or administrative, should be determined by Member State law.
