Recital 152
(152) 본 규정에서 행정적 처벌이 통일되어 있지 않거나 본 규정의 중대한 침해의 경우 등 기타의 경우에서 필요한 경우, 회원국들은 유효하고 온당하며 (침해행위를 하지 않도록 하는) 억지력이 있는 처벌을 규정하는 제도를 시행해야 한다.
관련 처벌의 성격이 형사적 또는 행정적인지는 회원국 법률에 의해 결정되어야 한다.
(152) Where this Regulation does not harmonise administrative penalties or where necessary in other cases, for example in cases of serious infringements of this Regulation, Member States should implement a system which provides for effective, proportionate and dissuasive penalties.
The nature of such penalties, criminal or administrative, should be determined by Member State law.
