Article 77 GDPR. Right to lodge a complaint with a supervisory authority
1. 在不影響任何其他行政或司法救濟之情況下,如資料主體認為與 其有關之個人資料處理違反本規則者,資料主體應有權向監管機關提 出申訴,尤其係向其住所地、工作地或受侵害地之會員國。
1. Without prejudice to any other administrative or judicial remedy, every data subject shall have the right to lodge a complaint with a supervisory authority, in particular in the Member State of his or her habitual residence, place of work or place of the alleged infringement if the data subject considers that the processing of personal data relating to him or her infringes this Regulation.
2. 受理申訴之監管機關應通知申訴人申訴之過程及結果,包括依第 78 條規定提起司法救濟之可能性。
2. The supervisory authority with which the complaint has been lodged shall inform the complainant on the progress and the outcome of the complaint including the possibility of a judicial remedy pursuant to Article 78.
第 78 條 GDPR. 對監管機關提起有效司法救濟之權利
Article 78 GDPR. Right to an effective judicial remedy against a supervisory authority
1. 在不影響任何其他行政或非司法救濟之情況下,自然人或法人應 有權對監管機關就其所為具有法律拘束力之處分提起有效司法救 濟。
1. Without prejudice to any other administrative or non-judicial remedy, each natural or legal person shall have the right to an effective judicial remedy against a legally binding decision of a supervisory authority concerning them.
2. 在不影響任何其他行政或非司法救濟之情況下,如第 55 條及第 56 條所定之監管主管機關不處理申訴或未於三個月內依照第 77 條規定 通知申訴人申訴進展或結果者,資料主體應有權提起有效之司法救 濟。
2. Without prejudice to any other administrative or non-judicial remedy, each data subject shall have the right to a an effective judicial remedy where the supervisory authority which is competent pursuant to Articles 55 and 56 does not handle a complaint or does not inform the data subject within three months on the progress or outcome of the complaint lodged pursuant to Article 77.
3. 對監管機關之訴訟應提交於監管機關設立地之會員國法院。
3. Proceedings against a supervisory authority shall be brought before the courts of the Member State where the supervisory authority is established.
4. 在委員會於一致性機制中提出意見或做出決定以前,已對監管機 關所為處分提起訴訟者,監管機關應將該意見或決定轉交法院。
4. Where proceedings are brought against a decision of a supervisory authority which was preceded by an opinion or a decision of the Board in the consistency mechanism, the supervisory authority shall forward that opinion or decision to the court.

1. 在不影響任何現有之行政或非司法救濟(包括依第 77 條向監管機 關提出申訴之權利)之情況下,如資料主體認為其依本規則所定之權利因未遵守本規則處理其個人資料而遭受侵害者,資料主體應有權提 出有效之司法救濟。
1. Without prejudice to any available administrative or non-judicial remedy, including the right to lodge a complaint with a supervisory authority pursuant to Article 77, each data subject shall have the right to an effective judicial remedy where he or she considers that his or her rights under this Regulation have been infringed as a result of the processing of his or her personal data in non-compliance with this Regulation.
2. 對於控管者或處理者提起之訴訟應提交至該控管者或處理者設有 分支機構之會員國法院。此外,除控管者或處理者係行使公權力之公 務機關外,亦可向資料主體住所地之會員國法院提起之。
2. Proceedings against a controller or a processor shall be brought before the courts of the Member State where the controller or processor has an establishment. Alternatively, such proceedings may be brought before the courts of the Member State where the data subject has his or her habitual residence, unless the controller or processor is a public authority of a Member State acting in the exercise of its public powers.
