(173) 本規則應適用於所有涉及保護個人資料處理之基本權及自由 之事件，且不限於歐洲議會及歐盟理事會之歐盟指令第 2002/58/EC 號[18]為同樣目的所規定之特定義務，包括控管者之義務及當事人之權 利。為釐清本規則與歐盟指令第 2002/58/EC 號之關係，該指令應依 本規則修訂。一旦通過本規則，歐盟指令第 2002/58/EC 號應受檢討， 尤其是為確保與本規則之一致性，
(173) This Regulation should apply to all matters concerning the protection of fundamental rights and freedoms vis-à-vis the processing of personal data which are not subject to specific obligations with the same objective set out in Directive 2002/58/EC of the European Parliament and of the Council [18], including the obligations on the controller and the rights of natural persons.
In order to clarify the relationship between this Regulation and Directive 2002/58/EC, that Directive should be amended accordingly.
Once this Regulation is adopted, Directive 2002/58/EC should be reviewed in particular in order to ensure consistency with this Regulation,
