Recital 153

(153) 회원국 법률은 언론, 학술, 예술 및 문학적 표현 등 표현과 정보의 자유를 통제하는 규정과 본 규정에 따른 개인정보 보호권 사이의 균형을 유지시켜야 한다.

단지 언론 목적이나 학술, 예술 또는 문학적 표현의 목적을 위한 개인정보 처리는 유럽연합 헌장 제11조에 구현된 바와 같이 개인정보 보호권과 표현 및 정보의 자유권 사이에 균형을 유지시킬 필요가 있을 경우, 본 규정의 특정 조문의 일부 적용 제외 또는 면제를 받아야 한다.

이는 특히 시청각 분야 및 뉴스 아카이브와 언론 도서관에서의 개인정보 처리에 적용된다.

따라서 회원국은 이 같은 기본권 간의 균형을 유지시키려는 목적에 필요한 적용의 면제 및 일부 제외를 규정하는 입법적 조치를 채택해야 한다.

회원국은 통칙, 정보주체의 권리, 컨트롤러와 프로세서, 협력 및 일관성, 그리고 특정 정보처리 상황에 대해 이 같은 적용의 면제 및 일부 제외를 채택해야 한다.

회원국 간에 이 같은 면제 또는 일부 적용 제외가 상이한 경우, 컨트롤러가 따라야 하는 회원국의 법률이 적용되어야 한다.

모든 민주사회에서 표현의 자유권이 가지는 중요성을 고려하기 위해 저널리즘 등 자유에 관련된 개념을 광범위하게 해석할 필요가 있다.

(153) Member States law should reconcile the rules governing freedom of expression and information, including journalistic, academic, artistic and or literary expression with the right to the protection of personal data pursuant to this Regulation.

The processing of personal data solely for journalistic purposes, or for the purposes of academic, artistic or literary expression should be subject to derogations or exemptions from certain provisions of this Regulation if necessary to reconcile the right to the protection of personal data with the right to freedom of expression and information, as enshrined in Article 11 of the Charter.

This should apply in particular to the processing of personal data in the audiovisual field and in news archives and press libraries.

Therefore, Member States should adopt legislative measures which lay down the exemptions and derogations necessary for the purpose of balancing those fundamental rights.

Member States should adopt such exemptions and derogations on general principles, the rights of the data subject, the controller and the processor, the transfer of personal data to third countries or international organisations, the independent supervisory authorities, cooperation and consistency, and specific data-processing situations.

Where such exemptions or derogations differ from one Member State to another, the law of the Member State to which the controller is subject should apply.

In order to take account of the importance of the right to freedom of expression in every democratic society, it is necessary to interpret notions relating to that freedom, such as journalism, broadly.
