(114) În orice caz, atunci când Comisia nu a luat o decizie cu privire la nivelul adecvat de protecție a datelor dintr-o țară terță, operatorul sau persoana împuternicită de operator ar trebui să utilizeze soluții care să ofere persoanelor vizate drepturi opozabile și efective în ceea ce privește prelucrarea datelor lor în Uniune odată ce aceste date au fost transferate, astfel încât persoanele vizate să beneficieze în continuare de drepturi fundamentale și garanții.
(114) In any case, where the Commission has taken no decision on the adequate level of data protection in a third country, the controller or processor should make use of solutions that provide data subjects with enforceable and effective rights as regards the processing of their data in the Union once those data have been transferred so that that they will continue to benefit from fundamental rights and safeguards.
