(32) Súhlas by sa mal poskytnúť jasným prejavom vôle, ktorý je slobodným, konkrétnym, informovaným a jednoznačným vyjadrením súhlasu dotknutej osoby so spracúvaním osobných údajov, ktoré sa jej týkajú, a to napríklad písomným vyhlásením vrátane vyhlásenia prostredníctvom elektronických prostriedkov alebo ústnym vyhlásením. Mohlo by to zahŕňať označenie políčka pri návšteve internetového webového sídla, zvolenie technických nastavení služieb informačnej spoločnosti alebo akékoľvek iné vyhlásenie či úkon, ktorý v tomto kontexte jasne znamená, že dotknutá osoba súhlasí s navrhovaným spracúvaním jej osobných údajov. Mlčanie, vopred označené políčka alebo nečinnosť by sa preto nemali pokladať za súhlas. Súhlas by sa mal vzťahovať na všetky spracovateľské činnosti vykonávané na ten istý účel alebo účely. Ak sa spracúvanie vykonáva na viaceré účely, súhlas by sa mal udeliť na všetky tieto účely. Ak má dotknutá osoba poskytnúť súhlas na základe požiadavky elektronickými prostriedkami, požiadavka musí byť jasná a stručná a nemala by pôsobiť zbytočne rušivo na používanie služby, pre ktorú sa poskytuje.
(32) Consent should be given by a clear affirmative act establishing a freely given, specific, informed and unambiguous indication of the data subject's agreement to the processing of personal data relating to him or her, such as by a written statement, including by electronic means, or an oral statement. This could include ticking a box when visiting an internet website, choosing technical settings for information society services or another statement or conduct which clearly indicates in this context the data subject's acceptance of the proposed processing of his or her personal data. Silence, pre-ticked boxes or inactivity should not therefore constitute consent. Consent should cover all processing activities carried out for the same purpose or purposes. When the processing has multiple purposes, consent should be given for all of them. If the data subject's consent is to be given following a request by electronic means, the request must be clear, concise and not unnecessarily disruptive to the use of the service for which it is provided.
(33) Často nie je možné v čase získavania údajov úplne určiť účel spracúvania osobných údajov na účely vedeckého výskumu. Preto by sa dotknutým osobám malo umožniť udeliť svoj súhlas pre určité oblasti vedeckého výskumu, pokiaľ sú dodržané uznávané etické normy vedeckého výskumu. Dotknuté osoby by mali mať možnosť udeliť svoj súhlas iba na určité oblasti výskumu alebo časti výskumných projektov v rozsahu, ktorý umožňuje zamýšľaný účel.
(33) It is often not possible to fully identify the purpose of personal data processing for scientific research purposes at the time of data collection. Therefore, data subjects should be allowed to give their consent to certain areas of scientific research when in keeping with recognised ethical standards for scientific research. Data subjects should have the opportunity to give their consent only to certain areas of research or parts of research projects to the extent allowed by the intended purpose.
(42) Ak je spracúvanie založené na súhlase dotknutej osoby, prevádzkovateľ by mal vedieť preukázať, že dotknutá osoba vyjadrila súhlas so spracúvaním. Najmä v kontexte písomného vyhlásenia v inej záležitosti by záruky mali zabezpečovať, že dotknutá osoba si je vedomá, že dáva súhlas a v akom rozsahu ho udeľuje. V súlade so smernicou Rady 93/13/EHS (10) by vyjadrenie súhlasu, ktoré vopred naformuloval prevádzkovateľ, malo byť v zrozumiteľnej a ľahko dostupnej forme a formulované jasne a jednoducho a nemalo by obsahovať nekalé podmienky. Aby sa zaistilo, že súhlas bude informovaný, dotknutá osoba by si mala byť vedomá aspoň identity prevádzkovateľa a zamýšľaných účelov spracúvania osobných údajov. Súhlas by sa nemal považovať za slobodný, ak dotknutá osoba nemá skutočnú alebo slobodnú voľbu alebo nemôže odmietnuť či odvolať súhlas bez nepriaznivých následkov.
(42) Where processing is based on the data subject's consent, the controller should be able to demonstrate that the data subject has given consent to the processing operation. In particular in the context of a written declaration on another matter, safeguards should ensure that the data subject is aware of the fact that and the extent to which consent is given. In accordance with Council Directive 93/13/EEC [10] a declaration of consent pre-formulated by the controller should be provided in an intelligible and easily accessible form, using clear and plain language and it should not contain unfair terms. For consent to be informed, the data subject should be aware at least of the identity of the controller and the purposes of the processing for which the personal data are intended. Consent should not be regarded as freely given if the data subject has no genuine or free choice or is unable to refuse or withdraw consent without detriment.
(43) Aby sa zabezpečilo, že súhlas sa poskytol slobodne, súhlas by nemal byť platným právnym dôvodom na spracúvanie osobných údajov v konkrétnom prípade, ak medzi postavením dotknutej osoby a prevádzkovateľa existuje jednoznačný nepomer, najmä ak je prevádzkovateľ orgánom verejnej moci, a preto nie je pravdepodobné, že sa súhlas poskytol slobodne za všetkých okolností danej konkrétnej situácie. Súhlas sa nepovažuje za poskytnutý slobodne, ak nie je možné dať samostatný súhlas na jednotlivé spracovateľské operácie osobných údajov napriek tomu, že by to bolo v konkrétnom prípade vhodné, alebo ak sa plnenie zmluvy vrátane poskytnutia služby podmieňuje takýmto súhlasom, aj keď to na takéto plnenie nie je takýto súhlas nevyhnutný.
(43) In order to ensure that consent is freely given, consent should not provide a valid legal ground for the processing of personal data in a specific case where there is a clear imbalance between the data subject and the controller, in particular where the controller is a public authority and it is therefore unlikely that consent was freely given in all the circumstances of that specific situation. Consent is presumed not to be freely given if it does not allow separate consent to be given to different personal data processing operations despite it being appropriate in the individual case, or if the performance of a contract, including the provision of a service, is dependent on the consent despite such consent not being necessary for such performance.
